Terms of Use

Draft. This text describes how the product works today, but it has not been reviewed by a lawyer, and the values shown [in brackets] still have to be filled in. Do not rely on it as final until this notice is removed.

1. Who we are

Superframe (“the service”) is operated by [legal entity name, legal form], registered at [registered address], [registration number]. You can reach us at [contact email].

Superframe is an independent product. It is not affiliated with, endorsed by or operated by Higgsfield AI or by any of the model providers whose models can be used through it.

2. What the service does

The service is a studio for generating images and videos with third-party AI models. You write a prompt, choose a model and its settings, optionally add your own images, video or audio as inputs, and the service sends that request to the generation platform and shows you the result.

3. Your account

You need an account to use the studio. You must give accurate information and keep your password secret.
You must be at least [minimum age — 13, 16 or 18 depending on your market] years old to create an account.
You are responsible for what happens under your account. Tell us promptly if you think it was compromised.
You can ask us to delete your account at any time by writing to the contact address above.

4. What you may not do

You agree not to use the service to create, upload or share content that:

is illegal, or sexualises minors in any way;
depicts a real person in a sexual, degrading or deceptive way without their consent;
impersonates someone to defraud or mislead, or is meant to pass as authentic footage of real events;
infringes someone else’s copyright, trademark, image rights or privacy;
harasses, threatens or incites violence or hatred against people.

You also agree not to probe or disrupt the service, get around its limits, resell access to it without our written agreement, or use it in a way that breaks the terms of the underlying model providers. Requests may be screened by the generation platform’s own moderation, which can refuse a prompt or a result.

5. Your content

You keep whatever rights you have in the prompts and files you provide. You give us permission to store, process and transmit them only as needed to run the service for you — which includes sending them to the generation platform that produces your result.

As between you and us, the results you generate are yours to use, subject to these terms and to the terms of the model that produced them. AI output may resemble other people’s output, and the law on ownership of AI output differs between countries: we make no promise that a result is protectable or free of third-party rights. You are responsible for how you use it.

6. Availability and retention

Generation depends on third-party platforms and can be slow, fail, or be unavailable. Generated files are hosted by the generation platform and are only guaranteed to stay available for a limited period (currently at least seven days). Download anything you want to keep.

7. Plans, credits and payments

Generating uses credits. The cost of a generation depends on the model and the settings you choose, and is shown before you press Generate. Credits have no cash value, cannot be transferred or exchanged for money, and can only be used on the service.

Plan credits. A subscription includes a number of credits for each month. They are added when the period is paid for and are valid until the next monthly refill. Unused plan credits do not carry over: at each refill the balance is set back to your plan’s monthly amount.
Extra credits. Credits bought as a pack are valid for 90 days from the day they are added. What is left after 90 days expires. When you generate, plan credits are used first, then the extra credits that expire soonest.
Generations. Credits are debited before submission. Confirmed failures and moderation refusals refund the debit to its original credit source, subject to its original expiry date.
Renewal. Subscriptions renew automatically at the end of each period, at the price then in force, until you cancel. If a renewal payment fails, your plan credits are paused until the payment goes through; we retry the payment, and if it keeps failing the subscription ends. Extra credits you bought are not affected.
Changing plan. Moving to a bigger plan takes effect immediately: both the price difference and additional credits are prorated for the time left in your period. Moving to a smaller plan takes effect at the end of the period you have already paid for.
Cancelling. You can cancel at any time from the Billing page. You keep your plan and its credits until the end of the period already paid for, and you can resume before that date. When the subscription ends, remaining plan credits are removed; extra credits stay until their own expiry date.
Payments. Payments are processed by Stripe. We do not see or store your full card number. Prices are displayed in US dollars, including applicable taxes, before you pay.
Refunds. [refund policy to be written with a lawyer: whether payments are refundable, the 14-day withdrawal right for EU consumers and how it applies once credits have been used].

We may change prices, the credits included in a plan, or the cost of a generation. A change to the price of your subscription applies from your next renewal, and we will tell you beforehand.

8. Suspension and termination

We may suspend or close an account that breaks these terms, puts the service or other people at risk, or where the law requires it. Where it is reasonable to do so we will tell you why. You may stop using the service at any time.

9. No warranty, limited liability

The service is provided “as is”. To the extent the law allows, we exclude implied warranties and we are not liable for indirect or consequential loss, or for content you generate or how you use it. Nothing in these terms limits liability that cannot legally be limited, or the rights you have as a consumer under the law of your country.

10. Changes

We may update these terms as the service evolves. If a change is significant we will tell you in the service or by email before it takes effect. Continuing to use the service after that date means you accept the new terms.

11. Governing law

These terms are governed by the law of [country / state], and disputes go to the courts of [jurisdiction], without taking away any mandatory protection you have where you live.
